Terms of Service

Welcome to Pictocards. These Terms of Service (“Terms”) are the agreement between you and us when you use Pictocards. Please read them — by creating an account, making a purchase, or using the app, you agree to them.
1. Who we are
Pictocards is operated by Pictocards (Jonathan Mathisen), Ärstavägen 10, 633 53 Eskilstuna, Sweden (“we”, “us”, “our”). You can reach us at team@pictocards.app.
2. Who can use Pictocards
Pictocards is made for children, but the account holder must be an adult aged 18 or over. By creating an account you confirm you are an adult and that you are setting up and supervising the child’s use. You are responsible for everything done under your account.
The app includes a “parent gate” before the shop, purchases, and settings, intended to keep those areas out of a child’s reach. It is a help, not a guarantee — please keep your device and account secure.
Pictocards is built so that no personal information is collected from a child. The account, and all the data tied to it, belongs to the adult account holder. How we handle that data is set out in our Privacy Policy.
3. Your account
We use passwordless sign-in: you enter your email and we send you a one-time code. Keep access to your email secure, since anyone with it could access your account. Tell us promptly if you think your account has been used without your permission. You can delete your account at any time from within the app.
We handle the personal data tied to your account in line with our Privacy Policy, which explains what we collect, why, and the choices and rights you have.
4. What you can buy
- Free Farm deck — available without signing up or paying.
- Themed decks — purchased individually.
- Founders Edition — a one-time purchase giving access to the current catalogue and to new decks we release during the access period described in section 6.
All purchases are one-time. There are no subscriptions and no recurring charges. Prices are shown at checkout in the applicable currency and include any taxes where required.
5. Payment and immediate access
Payments on the website are handled by our payment provider, Stripe. We never see or store your card details. When our mobile apps launch, purchases there will be handled by Apple’s App Store or Google Play under their own terms. Your access to what you bought is unlocked only after the provider confirms your payment to us.
Pictocards decks are digital content that is delivered to you immediately. When you buy a deck, you ask us to make it available to you right away and you agree that it unlocks in your library as soon as your payment is confirmed. You acknowledge that, because you receive immediate access, you lose the 14-day right of withdrawal that would otherwise apply to digital content under EU and Swedish consumer law. You confirm this by ticking the consent box at checkout before paying.
6. “Pay once, own forever” — what that means
We design Pictocards to be “pay once, own forever”: once a deck is in your library, you keep access to it for as long as we operate the service, at no further charge. “Forever” refers to continued access to the decks you already have — not to a promise of unlimited future content.
The Pictocards Founders Edition works a little differently. As well as the catalogue available at the time of purchase, you receive any new decks we release up to 7 June 2028, added to your library automatically and at no extra cost. After that date, you keep everything in your library and continue to access it, but new decks released afterwards are not included and require separate purchase. We aim to keep purchased content available indefinitely; if we ever have to retire a specific deck (for example, for legal or licensing reasons), we will give reasonable notice.
7. Refunds and your rights
Because your deck unlocks immediately and you agree to that at checkout, you do not have an automatic right to cancel and be refunded once a deck is unlocked. We are not obliged to refund a purchase simply because you changed your mind.
That said, we want you to be happy. If you regret a purchase, contact us at team@pictocards.app and we may, at our discretion and as a goodwill gesture, offer a refund on a case-by-case basis. This is voluntary and does not create a right to a refund in other cases.
None of this affects your statutory rights. If a deck is faulty, doesn’t work, or is not as described, you are entitled to a remedy under applicable consumer law — contact us and we’ll put it right.
8. Acceptable use
Please use Pictocards lawfully and as intended. You agree not to: copy, resell, or redistribute our decks, illustrations, or audio; try to break, probe, or interfere with the app or its security; access areas or accounts that are not yours; or use the service in any way that breaks the law.
9. Our content and your rights to use it
All the illustrations, photographs, audio, text, and design in Pictocards’ own decks belong to us or our licensors and are protected by intellectual-property law. When you buy a deck, we give you a personal, non-transferable, non-exclusive licence to use it within the app for your family’s or classroom’s own use. You may not sell, share, or publish our content outside the app.
10. The service is provided “as is”
We work hard to keep Pictocards available and accurate, but we provide it “as is” and “as available.” We don’t promise it will always be uninterrupted or error-free, and we may update, change, or pause features. Nothing in these Terms removes any rights you have under mandatory consumer law that cannot be excluded.
11. Our liability
To the extent allowed by law, we are not liable for indirect or unforeseeable losses, or for loss caused by events beyond our reasonable control. Nothing here limits liability that cannot be limited by law (for example, for death or personal injury caused by negligence, or for fraud). Where liability can be limited, our total liability to you is limited to the amount you paid us for the product the claim relates to, or the amount you paid us in the 12 months before the claim, whichever is greater.
12. Third-party services and availability
Pictocards depends on third-party providers to run — for example, our hosting, database, payment, email, and network providers, and the Apple and Google app stores. We choose reputable providers and do our best to keep the service running, but we do not control them and cannot be responsible for their failures, outages, delays, or changes. If one of these providers has a problem that interrupts or degrades Pictocards, that is outside our control (see section 13).
We aim to keep the service available but do not guarantee any particular uptime, and we may need to take it offline for maintenance, updates, or repairs. Where we reasonably can, we will try to schedule planned downtime sensibly and to restore service promptly. We take reasonable measures to back up data, but we cannot promise that data will never be lost, and we are not liable for loss or corruption of data caused by events outside our reasonable control.
13. Events outside our control (force majeure)
We are not responsible for failing to provide, or for delays in providing, the service when this is caused by events beyond our reasonable control. These include, for example: failures of the internet or telecommunications networks; power outages; failures or outages of our hosting, infrastructure, or other third-party providers; cyberattacks, denial-of-service attacks, or other malicious acts by third parties; fire, flood, extreme weather, or other natural events; epidemics or pandemics; strikes or industrial action; and acts of government, war, terrorism, or civil unrest. If such an event happens, we will try to limit its effect on you and to restore normal service as soon as we reasonably can.
14. Ending these Terms
You can stop using Pictocards and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, or if we are required to by law. If we end the service entirely, we will give reasonable notice where we can. Sections that by their nature should survive (such as content ownership, liability, and governing law) continue to apply after the Terms end.
15. Changes to these Terms
We may update these Terms from time to time. If we make important changes, we’ll update the “Last updated” date and, where appropriate, let you know by email or in the app. If you keep using Pictocards after a change takes effect, that means you accept the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of Sweden. If you are a consumer, you also keep the protection of any mandatory laws of the country you live in, and you can bring a claim in the courts there. EU consumers can also use the European Commission’s Online Dispute Resolution platform. We’d always prefer you contact us first at team@pictocards.app so we can try to put things right.
